Agreement Scope & Application

These Terms of Service constitute a legally binding agreement between you and CyberData Solutions governing your access to and use of our cyberpunk-inspired data engineering platform, services, and related digital infrastructure.

By accessing our services, submitting inquiries, or engaging with our platform, you acknowledge that you have read, understood, and agree to be bound by these terms and all applicable laws and regulations.

If you do not agree with any provision of these terms, you must immediately discontinue use of our services and refrain from accessing our platform or submitting any requests for consultation or technical assistance.

>
Maintain professional conduct in all communications and interactions with our team members

Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination of service access:

× Data mining or scraping without explicit authorization
× Spam, harassment, or abusive communications
× Trademark or copyright infringement activities
× False representation or fraudulent identity claims

Service Usage Terms & Limitations

Service Availability & Performance

Uptime Commitment: We strive to maintain 99.9% service availability while reserving the right for scheduled maintenance windows

Response Timeframes: Consultation requests receive acknowledgment within 24 hours during business operations

Service Modifications: We reserve the right to modify, suspend, or discontinue services with appropriate advance notice

Intellectual Property & Confidentiality

All proprietary methodologies, architectural designs, code implementations, and technical documentation remain the exclusive intellectual property of CyberData Solutions. Clients receive usage rights for delivered solutions without ownership transfer of underlying technologies.

Client-provided information and project specifications are treated as confidential and protected through appropriate security measures and non-disclosure protocols. We do not claim ownership of client data or business intelligence shared during service delivery.

Liability Limitations & Risk Allocation

Service Disclaimers: Our services are provided on an "as-is" basis without warranties of specific outcomes, performance guarantees, or business result commitments. While we implement industry best practices, we cannot guarantee specific system performance metrics or business outcomes.

Limitation of Liability: CyberData Solutions' total liability for any claims arising from service delivery shall not exceed the total amount paid for the specific service engagement giving rise to the claim.

Consequential Damages: We shall not be liable for indirect, incidental, special, or consequential damages including but not limited to loss of profits, data, or business opportunities.

Legal Framework & Dispute Resolution

Governing Law & Jurisdiction

Any legal disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts and arbitration systems

International clients acknowledge acceptance of Sri Lankan legal framework for dispute resolution

Force majeure events include natural disasters, government actions, and other circumstances beyond reasonable control

Alternative Dispute Resolution

Before initiating formal legal proceedings, parties agree to engage in good-faith mediation through qualified commercial arbitrators. This process shall be conducted confidentially with each party bearing their own costs unless otherwise agreed.

Terms Modification & Updates

Continued use of our services following terms updates constitutes acceptance of the revised agreement. Users who disagree with modifications should discontinue service usage immediately.

Severability & Enforcement

If any provision of these terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be replaced with enforceable terms that most closely reflect the original intent.
